When buyers purchase land in Portugal, the first thing they ask is: “Why can’t I just start building on it?” But owning land and having the right to build on it are two completely different things.

Many property advertisements often have what we call projeto aprovado (approved project). This is a technical file by a licensed architect that has been approved by the Câmara Municipal (local municipality).

Buying a plot with an approved project in Portugal can save you months in administration. You can customize the property within the parameters of the approved plans. You could buy land and build a property or purchase a ruin at a lower price and then renovate it.

However, to proceed with the development, you must have the proper permissions, otherwise you can face penalties and fines from the Portuguese authorities. Here is how planning approvals work in Portugal’s real estate market.

Approved Project in Portugal: What Is It

An approved architectural project, also known as projeto de arquitetura aprovado, is a file that describes different stages of a real estate planning process.

An architect licensed with the Order of Architects (Ordem dos Arquitectos) often prepares the project based on the owner’s needs. When it is ready, they send the project to the local municipality.

The architect must check every project case by case. For example, the Municipality of Lisbon (Municipio de Lisboa) can have different restrictions for urban development and construction than the one in the Algarve.

What does an approved project include?

The approved project means that the local municipality has approved very specific architectural designs.

It can include:

  • The exterior design
  • Layout of the house
  • Land or building measurements
  • Height of the property
  • Compliance with local building regulations

However, the approved project alone is not enough for you to build any type of property on the land you buy. It points out certain architectural designs that were approved by the local municipality, like restoring a stone house into a detached villa or adding another floor.

There are other laws and regulations that govern the real estate planning process and construction in Portugal, such as Plano Diretor Municipal (PDM), Plano de Urbanização (PU), Plano de Pormenor (PP), and Regime Jurídico da Urbanização e Edificação (RJUE).

Tip: If you are worried about the skeletal structure of a property, you may benefit from a structural engineer report in Portugal. This document can fill in the gaps of an approved project and check for roof issues, subsidence, cracks, and more.

What does the local municipality check?

The local municipality can check different factors of a property or plot, mainly:

  • Whether you can build, renovate, or expand a property on the land
  • Which uses are permitted, such as residential, commercial, hospitality or tourism
  • What construction restrictions apply, including building height, size, and positioning
  • Whether heritage protections, ecological restrictions, or rural land-use rules affect the property

If the project the architect sent fits certain criteria, the municipality offers a “green light” or an official confirmation for specific architectural designs to be added to that land or property.

Tip: The approved project is not a construction permit (licença de construção). The construction permit allows you to build, extend, or modify a property, while the former means you can only use an approved architectural design.

Why does an approved project matter for property buyers?

Depending on the scope of the project, the approval process could save you months of delays in administration, protect the future value of your asset, and prevent costly mistakes.

You may find it easier to plan your budget, considering the architect has already outlined some important parameters.

Latest Changes to Portugal’s Planning System

Portugal changed the way Pedido de Informação Prévia (PIP) works. The PIP, also known as a preliminary information request, is a formal question that you ask the municipality before you commit to a building project. For example: “Can I build this, right here?”

Decree-Law 108/2026 amended the RJUE after the 2024 Urban Planning Simplification Reform. The new rules came into effect on 1 October 2026.

A favorable, detailed PIP could allow you to start building a project right away without a separate construction license. For developers and property buyers, it can speed up the due diligence process.

How to protect yourself with a CPCV?

The Promissory Contract (CPCV – Contrato-Promessa de Compra e Venda) is a legally binding document that protects buyers and sellers in Portugal in the early acquisition process.

This pre-sale-purchase contract requires the buyer to provide around a 10-20% deposit of the purchase price to take the property off the market. If the seller backs out, they return the deposit to the buyer in double, and if the buyer cancels it, they lose their deposit.

You, as a buyer, can use the CPCV to check if the approved project matches the tax records and land registry documents before you finalize the sale.

This is an important step because you can add a clause to the CPCV that would allow you to recover your deposit if the legal due diligence reveals the approved project is not valid, or you cannot use it as advertised.
